Hi Chi22, Yes! The allegations came about after the CAFCASS report was released and after the first court hearing which neither party were present. My ex didn't seek exemption on any of the grounds. I paid for a MIAM but I don't know if they managed to get hold of my ex, and to be honest, I was way past the point of mediationActually, there are two things I can add.
1. Without reading back through your post history, if you have not already, then you must ask that this matter is set down for early Fact Finding. The former President of the Family Division has identified early Fact Finding as part of the effective 'case management' of difficult and protracted cases.
2. These allegations come after you have already been to court no? Did you/your ex seek a MIAM? DID she attempt to seek an exemption on any of grounds listed, most notably, domestic violence/controlling and coercive behaviour?
Agreed. I've heard of one person having been accused in real life, but other than that, just in one or two judgements. I don't even know how you'd begin to defend yourself against that.I don't think Cafcass would have helped organised the supervised time with the school, if they believed her allegations. Hopefully these allegations will just be dismissed. It is very much below the belt - but not quite the nuclear option. The nuclear option is when they accuse child sex abuse.
Yes it’s an order from the Judge that she gets the 3 reports doneI think you'll just have to wait and see what happens when you get to the hearing. Is it in an order that she has to produce these things?
Has anyone ever known anything the same or similar where the other party just won’t engage with my side. Surely taking part of the process is vital?What you need to watch is her trying to get this hearing adjourned saying she needs more time to get the reports. Be prepared to get your solicitor to object and say the hearing should still go ahead. I think it’s unlikely to happen and she may produce the reports on the day or just say she needs more time to get them or something.
